Terms and Conditions
The following attendee terms and conditions (“Terms”) govern your registration and participation in the Rosenfeld Media (RM) event in which you are registering (the “Event”). By clicking the “I accept” or “Submit” button during the registration process, or by attending or participating in the Event in any capacity, you accept and agree to be bound by these Terms and represent that you have read and understand all the provisions herein.
EVENT CANCELLATION, POSTPONEMENT OR MODIFICATION
Rosenfeld Media (“RM”) shall, at its sole discretion, be entitled to cancel, postpone, or modify the Conference and/or Workshop (“event”). RM will not be held responsible for any loss or damage arising from any change in the event or from the cancellation of or any change to the date(s), venue(s), or format for the event, for any reason whatsoever. In the event RM changes, cancels or postpones the event, RM shall give written notice of its decision as soon as reasonably practicable. Except as otherwise provided herein, the Attendee Fee is not refundable, and upon such notice, Attendee’s rights are limited to:
- In the case of RM’s cancellation of the Conference and/or Workshop, RM shall apply the fee toward attendance of another RM event of Attendee’s choice that is scheduled within thirty-six months from the date of such cancellation. If RM does not schedule any other event within said thirty-six month period, then the Attendee Fee shall be refunded to Attendee after the end of the thirty-six month period upon written request. Attendee must choose a replacement Conference and/or Workshop within thirty-six months, after which the fee credit will expire.
- In the case of the conversion to a Virtual/Remote Conference and/or Workshop, or in the case of the postponement of a Conference and/or Workshop, the Attendee shall have the choice to attend the Conference and/or Workshop or to credit the full Attendee Fee to a future event to be chosen by Attendee within thirty-six months. If RM does not schedule any other event within said thirty-six month period, then the Attendee Fee shall be refunded to Attendee after the end of the thirty-six month period upon written request. Attendee must choose a replacement Conference and/or Workshop within thirty-six months, after which the fee credit will expire.
INTELLECTUAL PROPERTY RIGHTS
All intellectual property rights in and to the event, the event content, and all materials distributed at or in connection with the event are owned by RM, our related companies, and/or the sponsors or speakers attending the event. You must not reproduce or allow anyone one to reproduce trademarks or materials distributed by or on behalf of us at an event for any reason, without our prior written permission.
Nothing in these Terms shall vest in you any legal or beneficial right in or to any intellectual property rights owned or used under license by us or our related companies, or grant to you any right or license to any other intellectual property rights of us or our related companies. All such intellectual property rights shall remain the exclusive property of us and our related companies.
It is strictly forbidden for any company, organization, or person to attempt to host or organize any event in conjunction with, contiguous to or purporting to be related to the event or its affiliates without our express prior permission and cooperation.
SPEAKER OR WORKSHOP LEADER CANCELLATIONS
We do our best to deliver a relevant and meaningful event experience. Should an advertised speaker or workshop leader be unable to attend due to illness or other factors beyond the control of RM, we reserve the right to make the best possible substitution that meets our standards. Should a last minute issue arise where RM cancels a program segment, our liability shall be limited to the refund on a prorata basis of the amount paid for that program segment.
FORCE MAJEURE
RM shall not be deemed to be in breach of this Agreement or otherwise liable to the Attendee for any failure or delay in performing its obligations under this Agreement as a result of any event or series of connected events outside the reasonable control of RM including, without limitation, acts of God, floods, lightning, storm, fire, explosion, war, military operations acts or threats of terrorism, strike action, lock-outs or other industrial action, adverse action or bankruptcy of key vendor, any legislation, regulations, ruling or omission of any relevant government, court, competent national authority or governing body, or a pandemic, epidemic or other widespread illness or disease (a “Force Majeure”).
